§1 Privacy Policy

GDPR

1.1 Controller. SmartSoftwareFlow, ul. Półwiejska 32, 61-888 Poznań, Poland (email: [email protected]), is the data controller for personal data processed through this website and related client communications.

1.2 What we collect. We process identification and contact data you submit (name, email, phone, company, project notes), technical logs required to serve the site, and billing references when you use our payment ledger.

1.3 Purpose and legal basis. Data is processed to respond to inquiries, prepare proposals, deliver contracted software work, meet statutory accounting duties, and maintain site security. Legal bases include contract performance, legitimate interests in operating a professional software practice, and consent where you opt in to marketing or non-essential cookies.

1.4 Sharing. We do not sell personal data. Data may be shared with hosting, email, analytics, and payment providers strictly as processors or payment intermediaries under appropriate safeguards, and with authorities where law requires it.

1.5 Retention. Inquiry and contract records are kept for the period needed for the purpose plus statutory limitation and tax retention periods under applicable Polish and EU law.

§2 Terms of Service

CONTRACT

2.1 Scope. These terms govern use of smartsoftwareflow.com and engagement with SmartSoftwareFlow for software development, architecture, integration, audit, and related professional services, including proprietary platform builds for commercial clients.

2.2 Proposals and orders. Website figures are starting references. A binding engagement exists only when both parties accept a written proposal or statement of work confirming scope, fees, timeline, and acceptance criteria.

2.3 Payment. Invoices are payable according to the agreed schedule (typically deposit, milestone, and final balance). Late amounts may accrue statutory interest and collection costs. Secure online settlement is available via our payment ledger (Stripe).

2.4 Intellectual property. Upon full payment, client-specific deliverables created under a paid statement of work transfer to the client as described in that engagement. SmartSoftwareFlow retains rights in pre-existing frameworks, tooling, libraries, and internal know-how, licensed as needed for the client’s use of the deliverables.

2.5 Client responsibilities. The client provides timely access to systems, stakeholders, content, credentials, and decisions required to progress work. Delayed inputs may extend timelines without penalty to SmartSoftwareFlow.

2.6 Acceptance. Deliverables are deemed accepted if no material non-conformity is notified in writing within the acceptance window stated in the proposal, or upon use in production.

2.7 Confidentiality. Each party will protect the other’s confidential information with at least reasonable care and use it only for the engagement, except for information already public or independently developed.

2.8 Warranty and liability. Services are performed with professional skill and care. To the maximum extent permitted by law, liability for indirect or consequential losses is excluded; aggregate liability is limited to fees paid for the affected services in the preceding twelve months, except where liability cannot be limited by law (e.g. wilful misconduct).

2.9 Term and termination. Either party may terminate for material breach uncured after reasonable notice. On termination, client pays for work performed and committed costs; SmartSoftwareFlow returns or deletes client materials subject to retention duties.

2.10 Governing law. Polish law applies; courts in Poznań have jurisdiction, without prejudice to mandatory consumer protections.

§3 Cookie Policy

SESSION

3.1 What cookies are. Cookies and similar storage identifiers help this site remember preferences, support essential functionality, and measure aggregate usage.

3.2 Essential storage. SmartSoftwareFlow uses necessary storage such as cookie-consent persistence (localStorage/cookies) so we do not re-prompt you and can honor your choice.

3.3 Analytics and marketing. Where enabled, analytics or advertising cookies help us understand traffic and campaigns. Non-essential categories run only after consent where required.

3.4 Payment processors. When you use our secure payment link, third-party processors such as Stripe may set cookies or session tokens needed to complete and secure the transaction under their own policies.

§4 Refund Policy

PAYMENTS

4.1 Deposits. Deposits secure capacity and compensate pre-delivery discovery work. Deposits are non-refundable once work has commenced, unless SmartSoftwareFlow cancels without cause.

4.2 Milestones. Completed milestones are non-refundable. If a project is paused or cancelled by the client, amounts due cover work performed and non-cancellable third-party costs incurred to date.

4.3 Defects. If a deliverable fails agreed acceptance criteria within the stated warranty window, SmartSoftwareFlow will repair or re-perform at no additional fee. Refunds of paid fees for materially defective work are considered only after remediation has been given a reasonable opportunity and fails.

4.4 Retainers. Monthly retainers are billed in advance. Unused reserved capacity is generally non-refundable except where a full month is cancelled before service starts, or law requires otherwise.

4.5 Duplicate or erroneous charges. Verified duplicate or erroneous charges paid to SmartSoftwareFlow are refunded to the original payment method within a reasonable period after investigation.

4.6 Consumer rights. Where mandatory consumer law provides additional withdrawal or remedy rights (e.g. remote contracts), those rights prevail over any broader commercial term to the extent of conflict.
